Welcome to Motion Edit Media (“Motion Edit Media,” “we,” “us,” or “our”). These Terms & Conditions govern your access to and use of our website and our video editing, post-production, and creative media services.

By accessing our website, submitting an enquiry, placing an order, or engaging our services, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please do not use our website or services.

1. Our Services

Motion Edit Media provides professional creative and post-production services, which may include:

Video editing
Short-form video and Reels editing
YouTube video editing
Social media content editing
Advertisement video editing
Corporate video editing
Product video editing
Motion graphics
Subtitles and captions
Colour correction and colour grading
Audio enhancement
Promotional content
Other creative and post-production services agreed upon with the client

The exact scope of work, deliverables, timelines, revisions, pricing, and other project requirements may be agreed upon separately with each client.

2. Client Responsibilities

To enable us to complete your project efficiently, you agree to:

Provide all required footage, images, audio, logos, scripts, brand guidelines, and other materials.
Provide accurate project instructions and requirements.
Ensure that the content supplied to us is complete and usable.
Respond to requests for clarification or approval within a reasonable time.
Ensure that you have the necessary rights and permissions to use all materials supplied to us.

Delays caused by missing files, incomplete information, late feedback, or changes in requirements may affect the project delivery timeline.

3. Ownership of Client Materials

You retain ownership of the original materials and intellectual property that you provide to Motion Edit Media.

This may include:

Raw footage
Images
Logos
Brand assets
Scripts
Audio
Graphics
Documents
Other materials supplied by you

By submitting these materials, you grant Motion Edit Media the necessary permission to use them solely for the purpose of providing the agreed services.

You are responsible for ensuring that your submitted materials do not infringe the intellectual property, privacy, or other rights of any third party.

4. Ownership of Final Deliverables

Unless otherwise agreed in writing, ownership or usage rights for the final approved deliverables will be transferred to the client according to the agreed project terms and after all applicable payments have been received.

Motion Edit Media may retain copies of project files for legitimate business, backup, support, or legal purposes, subject to our Privacy Policy.

Third-party assets used in a project, including licensed music, stock footage, fonts, templates, plugins, graphics, or other resources, may remain subject to their respective licenses and terms.

5. Revisions

The number of revisions included in a project will depend on the package or quotation agreed upon with the client.

A revision generally means reasonable modifications to the agreed creative direction or existing edit.

Requests that significantly change the original project scope may be treated as additional work and may incur additional charges.

Examples include:

Changing the entire editing concept
Replacing a large portion of the footage
Creating additional versions
Adding new scenes after approval
Changing the original video format
Requesting substantially different creative direction
6. Project Timeline

We will make reasonable efforts to deliver projects within the agreed timeframe.

However, delivery timelines may change because of:

Late submission of materials
Delayed client feedback
Additional revision requests
Changes in project scope
Technical problems
Third-party service interruptions
Circumstances beyond our reasonable control

The delivery date may be extended where such circumstances affect the project.

7. Payments

Project pricing and payment schedules will be communicated before work begins.

Depending on the project, we may require:

An advance payment before starting work
Milestone payments
Full payment before final delivery
Subscription or recurring payments

Unless otherwise agreed, work may not begin until the required advance payment has been received.

Final high-resolution or editable/source files may be withheld until all outstanding payments have been cleared.

8. Late or Non-Payment

If a client fails to make a required payment within the agreed timeframe, Motion Edit Media may:

Pause the project
Suspend revisions
Delay delivery
Withhold final files
Cancel the project
Recover applicable outstanding amounts

Any additional costs arising from payment delays may be charged where agreed or permitted by applicable law.

9. Cancellation of Projects

A client may request cancellation of a project by contacting Motion Edit Media.

If work has already started, amounts paid may not be refundable to the extent they cover work already completed, resources already purchased, third-party costs, or time already allocated to the project.

Any refund, if applicable, will be determined according to the specific project agreement and applicable law.

10. Client Approval

Before final delivery, clients may be provided with previews or drafts for review.

Once a final version has been approved by the client, subsequent changes may be treated as additional revisions and may incur additional charges.

Clients are responsible for carefully reviewing the final content before publishing or distributing it.

11. Third-Party Assets

Projects may sometimes include third-party resources such as:

Stock footage
Stock images
Music
Fonts
Sound effects
Templates
Plugins
AI-assisted assets
Other licensed resources

Where applicable, the use of such resources may be subject to separate licensing terms.

Motion Edit Media will make reasonable efforts to use third-party resources appropriately, but clients are responsible for complying with any applicable license restrictions where those rights are transferred to or used by the client.

12. AI-Assisted Tools

Motion Edit Media may use modern software and AI-assisted tools where appropriate to improve creative production, editing, enhancement, automation, or workflow efficiency.

The use of such tools does not necessarily mean that every project is entirely AI-generated.

Where third-party AI or software services are used, their respective terms and policies may apply.

13. Portfolio Rights

Motion Edit Media may showcase selected completed work in its:

Website
Portfolio
Social media
Presentations
Marketing materials
Promotional campaigns

However, where a project is subject to confidentiality restrictions, an NDA, or an explicit agreement prohibiting promotional use, we will respect those restrictions.

Clients may communicate specific confidentiality requirements before or during the project.

14. Confidentiality

We understand that clients may provide confidential business information, unreleased campaigns, product information, creative concepts, and other sensitive project materials.

Motion Edit Media will make reasonable efforts to keep such information confidential and use it only as necessary to provide the agreed services.

Where a separate Non-Disclosure Agreement (“NDA”) has been executed, the confidentiality obligations contained in that agreement will also apply.

15. Intellectual Property Rights

You agree not to provide content to Motion Edit Media that:

Infringes another person’s copyright
Violates trademark rights
Violates privacy rights
Contains unlawful material
Uses third-party content without appropriate permission

If a third party makes a claim relating to materials supplied by you, you may be responsible for resolving that claim.

Motion Edit Media reserves the right to refuse or discontinue work involving content that we reasonably believe may violate applicable laws or third-party rights.

16. Website Use

You agree to use the Motion Edit Media website only for lawful purposes.

You must not:

Attempt to gain unauthorized access to the website
Introduce malicious software or code
Interfere with website functionality

The performance of published content can depend on factors outside our control, including audience behaviour, platform algorithms, advertising budgets, competition, market conditions, and distribution strategy.

19. Limitation of Liability

To the maximum extent permitted by applicable law, Motion Edit Media will not be liable for indirect, incidental, consequential, or special losses arising from the use of our website or services.

This may include loss of:

Profits
Revenue
Business opportunities
Data
Reputation
Expected business results

Our liability, where legally applicable, will generally be limited to the amount paid by the client for the specific service giving rise to the claim, unless otherwise required by applicable law.

20. Force Majeure

Motion Edit Media will not be responsible for delays or failure to perform caused by circumstances beyond our reasonable control.

Server outages
Power failures
Cybersecurity incidents
